What Norms and Values Should Govern Business?

1. Topic 4.3.1 applied the ethical frameworks from this unit to biomedical science, examining questions of life, death, and the responsible use of technology. This topic turns to a different domain of applied ethics: the world of commerce, industry, and corporate activity.
2. The central question is straightforward but philosophically rich: what norms and values should govern business?
3. This question matters because business decisions affect the lives of millions of people: workers, consumers, communities, and future generations. The normative theories examined in 4.1 (deontological, teleological, and virtue-based) each offer distinct frameworks for evaluating corporate conduct, and the meta-ethical questions of 4.2 (are moral values universal or relative?) are directly relevant to global business practices that span diverse cultures.
4. Deontological approaches to business ethics ask whether business practices respect moral duties and rights. Kant’s categorical imperative prohibits treating persons merely as means.
5. Applied to business, this principle condemns exploitative labour practices, deceptive advertising, and any corporate activity that treats workers or consumers as mere instruments of profit rather than as persons with inherent dignity.
6. Utilitarian approaches evaluate business practices by their consequences for overall welfare. A utilitarian analysis asks whether a decision maximizes total well-being across all affected parties: shareholders, employees, consumers, and the wider community.
7. This consequentialist framework can justify practices that produce net benefits but may struggle with cases where profits come at the expense of vulnerable minorities.
8. Virtue ethics asks not just whether a business practice is permissible but what it reveals about the character of the decision-makers. A virtuous businessperson demonstrates honesty, fairness, courage, and practical wisdom in navigating complex commercial situations.
9. Aristotle’s emphasis on the social dimension of virtue is particularly relevant: business operates within and depends upon a community whose flourishing it either supports or undermines.

Cultural Context, Shareholder Theory, and Stakeholder Theory

1. The overarching Unit 4 question, “Are moral decisions culturally influenced?”, is acutely relevant to business ethics. Multinational corporations operate across cultures with different moral norms.
2. Practices considered acceptable in one country (such as certain forms of gift-giving that might be classified as bribery elsewhere) raise the question of whether business ethics can be universal or must always be adapted to local cultural contexts.
3. Milton Friedman articulated the most influential minimalist position on business ethics in his 1970 essay “The Social Responsibility of Business Is to Increase Its Profits.” Friedman argued that a corporation’s only social responsibility is to maximize shareholder value within the law.
4. On this view, corporate executives who spend company resources on social causes are effectively taxing shareholders without their consent and usurping the role of democratic institutions.
5. R. Edward Freeman challenged Friedman's position with stakeholder theory, arguing that businesses have moral obligations not just to shareholders but to all parties affected by their operations: employees, customers, suppliers, communities, and the natural environment. Freeman's framework requires managers to balance competing interests and to treat all stakeholders as having legitimate claims on the corporation's decisions and resources.
6. The debate between shareholder theory and stakeholder theory reflects a deeper philosophical tension: should businesses look out only for themselves and their investors (a kind of self-interest-first thinking), or do they owe something to everyone around them? If business exists solely to generate profit, its moral obligations are minimal.
7. If business is a social institution embedded in a web of relationships and responsibilities, its moral obligations are extensive. IB students should be able to articulate both positions and evaluate them using the normative frameworks from 4.1.

Fair Trade, Child Labour, and Business Espionage

Fair Trade

1. The IB syllabus requires engagement with three specific business ethics cases: fair trade, child labour, and business espionage. Each case tests the normative frameworks from 4.1 in a distinctive way and raises questions about the relationship between moral principles and economic realities.
2. Fair trade is a movement that seeks to ensure producers in developing countries receive a fair price for their goods, rather than having prices dictated solely by market forces. Philosophically, fair trade raises the question of whether the free market is inherently just or whether structural inequalities in global trade require corrective intervention.
3. Utilitarian analysis asks whether fair trade produces better outcomes overall; deontological analysis asks whether paying poverty wages violates the dignity of workers.
4. The argument for fair trade draws on principles of justice: if global economic structures systematically disadvantage producers in poorer countries, fairness requires adjusting the terms of trade. John Rawls’s concept of justice as fairness holds that inequalities are only justified if they benefit the least advantaged members of society.
5. Fair trade can be seen as an application of this principle to international commerce.
6. Critics of fair trade argue that it distorts market signals, discourages diversification, and may not reach the most vulnerable producers. Some economists contend that free trade, despite its inequalities, is more effective at reducing poverty in the long run.
7. This debate illustrates the tension between deontological commitments to fairness and consequentialist assessments of what policies actually work.

Child Labour

1. Child labour is one of the most morally charged issues in business ethics. From a deontological perspective, employing children in hazardous or exploitative conditions violates their rights and dignity.
2. Children cannot give meaningful consent to labour, and depriving them of education undermines their future autonomy. The United Nations Convention on the Rights of the Child (1989) establishes a legal and moral framework for protecting children from economic exploitation.
3. However, the issue is complicated by cultural and economic context. In some developing countries, child labour is a survival strategy for families with no alternative income.
4. A simplistic prohibition may leave families worse off. This raises the Unit 4 question of whether moral principles are universal or must be applied with sensitivity to local conditions.
5. The philosophical challenge is to maintain a commitment to children's rights while addressing the structural poverty that makes child labour seem necessary.
6. The International Labour Organization (ILO) sets minimum age standards for employment, reflecting a global consensus that children's right to education takes precedence over economic necessity.

Business Espionage

1. Business espionage (the theft or unauthorized acquisition of trade secrets, proprietary data, or confidential strategies) raises questions about the limits of competition. From a Kantian perspective, espionage involves deception and the violation of trust, treating competitors as mere obstacles to profit rather than as participants in a legitimate market.
2. It also fails Kant's test of universalizability (asking: what would happen if everyone did this?): if every business engaged in espionage, the trust and fair competition that markets depend on would collapse entirely.
3. A utilitarian analysis of business espionage weighs the short-term gains to the spy against the broader damage to trust, innovation, and the functioning of markets. If businesses cannot protect their intellectual property, the incentive to innovate diminishes, producing worse outcomes for society as a whole.
4. Even from a purely consequentialist standpoint, business espionage undermines the conditions for a productive and innovative economy.
5. These three cases share a common philosophical structure: each involves a tension between profit-seeking behaviour and moral obligations to others. The question is not whether businesses should be ethical (virtually everyone agrees they should) but how far ethical obligations extend and how conflicts between profit and morality should be resolved.
6. The normative frameworks from 4.1 provide different answers, and IB students should be prepared to deploy all three.

Corporate Responsibility and the Broader Picture

Ethical Frameworks for CSR

1. Corporate social responsibility (CSR) refers to the idea that businesses have obligations to society that extend beyond the legal requirement to make a profit. CSR encompasses environmental stewardship, fair labour practices, community engagement, and ethical governance.
2. The philosophical question is whether CSR is a genuine moral obligation or merely a strategic tool for enhancing brand reputation.
3. From a Kantian perspective, CSR is a moral obligation rooted in the dignity of persons. Corporations interact with employees, consumers, and communities in ways that affect their well-being and autonomy.
   1. The categorical imperative requires that these interactions respect persons as ends in themselves, not merely as inputs to the production process or as sources of revenue.
   2. From a utilitarian perspective, CSR is justified when it produces net positive outcomes for all stakeholders. Investing in employee welfare, reducing environmental harm, and supporting communities can create long-term value that benefits shareholders and society alike.
4. This "enlightened self-interest" argument holds that CSR and profitability are not necessarily in conflict; responsible businesses may outperform irresponsible ones over time.
5. Virtue ethics offers a distinctive perspective on CSR. Rather than asking whether CSR maximizes profits or fulfils duties, it asks what kind of corporate character CSR expresses.
6. A company that treats CSR as a superficial marketing exercise shows a different character from one that genuinely builds ethical values into its everyday operations.
7. Aristotle's idea of habituation (the idea that you become virtuous by repeatedly doing virtuous things, not by occasional good deeds) suggests that corporate virtue, like personal virtue, is built through consistent practice rather than occasional gestures.

Corporate Moral Agency

1. The concept of moral agency raises a deeper philosophical question: can a corporation be a moral agent in the same way that an individual person can?
2. Peter French argued that corporations have internal decision-making structures that give them something like a will of their own, meaning that when a corporation does something harmful, we can genuinely blame the corporation, not just the individual employees who carried out the decision.
   1. Critics respond that only individual human beings can be moral agents and that attributing moral responsibility to corporations obscures the accountability of specific decision-makers.
3. French's key concept is the Corporate Internal Decision (CID) structure: the formal policies, chains of command, and procedures through which a corporation makes its choices.

1. French argues this means the corporation's decision cannot be reduced to the choices of its individual employees: the decision belongs to the corporation itself, and so does the moral responsibility. Critics respond that only beings with genuine consciousness can be moral agents, and that talking about corporate 'will' is just a shorthand for many people making coordinated choices.
2. The practical stakes are significant: if French is right, a corporation can be blameworthy even when no individual employee acted wrongly.
3. The legal concept of corporate personhood, recognised in many jurisdictions, partly supports French: corporations can hold rights, sign contracts, and be held legally liable, which means that in practice the law already treats them as a kind of agent, even if philosophers are still debating whether that agency is philosophically genuine.

Environmental Responsibility and Broader Context

1. The environmental dimension of corporate responsibility has become increasingly urgent. Climate change, pollution, and resource depletion raise questions about the obligations of businesses to future generations.
2. The principle of intergenerational justice (the idea that people alive today have duties to people not yet born, to be examined in Unit 9) holds that current actors must not exhaust the planet's resources for short-term profit, a principle that directly challenges the quarterly-earnings focus of much corporate decision-making.
3. Business ethics connects to the broader themes of this unit. The question "How should we treat people?" applies directly to how corporations treat their workers, consumers, and communities.
4. The question of whether moral principles are universal (4.2) determines whether global corporations can maintain a single ethical standard across diverse cultural contexts.
5. The next topic (4.3.3) will examine the distribution of wealth, asking what ethical responsibilities we have regarding poverty and inequality. Business ethics and wealth distribution are deeply connected: the way businesses operate directly shapes the distribution of resources within and between societies.
